Why you need a disability impact statement?

The Employment Tribunal will ask you to prepare a Disability Impact Statement at the first case management Preliminary Hearing. To get anywhere at all with a disability discrimination claim, your disability must fit within the definition of disability in section 6 of the Equality Act 2010. This requires you to show that your disability has a ‘substantial adverse effect’ on your ability to carry out normal day-to-day activities. If you get this part wrong you will be deemed not to be disabled, and your claim for disability discrimination will be thrown out. The Disability Impact Statement is how you tell the employment tribunal about the impact of your disability on your normal day-to-day activities.
