Approved English Apprenticeship
An arrangement under the Apprenticeships, Skills, Children and Learning Act 2009 (ASCL 2009), that takes place under an approved English apprenticeship agreement between employer and apprentice or is an alternative English apprenticeship. In either case, it must satisfy conditions specified in regulations made by the Secretary of State. The approved English apprenticeship agreement is a combination of paid employment and training towards achievement of a recognised standard. The Secretary of State can make regulations requiring the apprenticeship and the agreement to satisfy specified conditions. The status of such an agreement is a contract of service. That is the same status as an apprenticeship agreement under the ASCL 2009. In relation to apprenticeship standards, the approved English apprenticeship agreement must also (i) set out the amount of time the apprentice will spend in off-the-job training, and (ii) the planned end date of the apprenticeship’s practical period, called the “final day”. These requirements are provided for in the Apprenticeships (Miscellaneous Provisions) Regulations 2017. In relation to apprenticeship frameworks, there must be an apprenticeship agreement in place which (i) meets the employer’s duty under section 1 of the Employment Rights Act 1996 and (ii) includes a statement of the skill, trade or occupation for which the apprentice is being trained under the apprenticeship framework. These requirements are provided for in the Apprenticeships (Form of Apprenticeship Agreement) Regulations 2012.
