Restraint of trade

Restraint of trade is a legal principle that an employee should be free to follow their trade and use their skills without interference by the employer. So, any contractual terms that restrict you from working for another employer or carrying out your trade (a restrictive covenant) is unlawful unless your employer can prove that it is meant to protect a legitimate business interest, and other stringent criteria.
